Contrairement au préjugé occidental d’un culte asocial, le bouddhisme dans ses différentes écoles fut fortement impliqué dans la vie sociale et politique des régions qu’il a traversées. Un autre cliché est de ne voir dans cette religion qu’une spiritualité, presque une hygiène de vie, faite de méditation dénuée de règles morales et juridiques. L’ouvrage se dégagent de ces idées reçues en présentant les sources des normes bouddhiques, celles qui régissent la communauté monacale, mais aussi celles qui s’adressent aux laïcs, relatives à la famille, à la sexualité, au comportement personnel, au travail, à la propriété, au commerce, aux relations entre religion et politique. Il entend montrer que du Tibet au Japon en passant par la Chine, les écoles bouddhistes se sont inscrites dans des contextes culturels qu’elles ont influencés mais qui ont aussi été influencés par elles. Ces interactions entre religion et cultures se reflètent dans le miroir des normes, jusqu’à la rencontre avec la modernité occidentale, cause pour certains d’une déformation du message bouddhique originel. Mais l’origine n’est-elle pas toujours mythique ? Ceux qui cherchent à réhabiliter une tradition ne tombent-ils pas dans le travers qu’ils voudraient éviter : la reconstruction de normes qui leur paraissent plus adéquates, autrement dit mieux adaptées à leur situation actuelle ? Les auteurs ont tenté de faire reposer ces questions sur des recherches historiques, juridiques et sociologiques.

Lawyer and writer Mike Godwin has been at the forefront of the struggle to preserve freedom of speech on the Internet. In Cyber Rights he recounts the major cases and issues in which he was involved and offers his views on free speech and other constitutional rights in the digital age. Godwin shows how the law and the Constitution apply, or should apply, in cyberspace and defends the Net against those who would damage it for their own purposes. Godwin details events and phenomena that have shaped our understanding of rights in cyberspace--including early antihacker fears that colored law enforcement activities in the early 1990s, the struggle between the Church of Scientology and its critics on the Net, disputes about protecting copyrighted works on the Net, and what he calls "the great cyberporn panic." That panic, he shows, laid bare the plans of those hoping to use our children in an effort to impose a new censorship regime on what otherwise could be the most liberating communications medium the world has seen. Most important, Godwin shows how anyone--not just lawyers, journalists, policy makers, and the rich and well connected--can use the Net to hold media and political institutions accountable and to ensure that the truth is known.

Le présent ouvrage réunit la plupart des contributions qui ont été présentées lors des journées de formation en criminologie organisées les 27 et 28 avril 1989 par l'École de criminologie de l'Université catholique de Louvain et la Faculté de droit des Facultés universitaires Saint-Louis. L'objectif premier est d'éclairer une problématique à la fois complexe, peu connue et d'une grande actualité dans le cadre de la protection de la jeunesse : le placement des mineurs en institution psychiatrique ouverte et fermée. Quatre questions sont abordées. Quelles sont les différentes voies juridiques permettant un tel placement ? Quelle est la nature et la fonction des interventions psychologiques et psychiatriques au niveau judiciaire ? Quelles sont les institutions qui accueillent les mineurs ? Comment concilier traitement psychiatrique et droits de l'homme ? Sur chacun de ces thèmes, se trouvent confrontés les points de vue du théoricien et du praticien, ceux du juriste, du psychologue et du psychiatre.

At the invitation of the New America Foundation and the New York University Center for Law and Security, a group of individuals regarded as authorities on international terrorism and Al Qaeda were brought together at a meeting held in the United States Senate office building. This volume contains the presentations that were made at this meeting. They constitute a valuable synopsis of current knowledge on Al Qaeda and the policies in place to counter threats of future terrorist attacks. The papers in this book will contribute to understanding how Al Qaeda has evolved from a movement to an ideology, what influence it has on Middle East stability and what continued threat it is to the United States, Europe, and other areas of the world.
